  1. ACCEPTANCE OF TERMS
    Welcome to Moreton Regional Support Services. By accessing, purchasing, or using our products and services, you agree to be bound by these Terms of Service. If you do not agree, you must not use our website or purchase our products.
  2. DEFINITIONS
    • “We,” “our,” “us” refers to Moreton Regional Support Services.
    • “You,” “your” refers to the purchaser, customer, or user of our products and services.
    • “Templates,” “documents” refers to the NDIS-related documents and other materials available for purchase.
    • “Website” refers to our online platform where we provide products and services.
  3. GENERAL TERMS
    • These Terms of Service govern your use of our website, products, and services.
    • We reserve the right to update, modify, or discontinue any aspect of our offerings at any time without prior notice.
    • Continued use of our services after changes constitutes acceptance of the updated terms.
  4. PRODUCT USE & DISCLAIMER
    • All templates sold by Moreton Regional Support Services are provided as general reference materials and do not constitute legal, financial, or professional advice.
    • They are designed to serve as general guidance only and may not address your specific business circumstances, regulatory requirements, or operational needs.
    • We do not warrant or guarantee that these templates are complete, accurate, up-to-date, or fully compliant with NDIS Practice Standards, Australian laws, or any regulatory requirements applicable to your business, nor do we guarantee successful registration of your NDIS business with the use of these templates.
    • It is your responsibility to review, modify, and ensure the documents align with your specific business needs and legal requirements.
    • We strongly recommend seeking independent legal, financial, or professional advice before using our templates.
    • Purchasing a template does not create any legal, business, or professional relationship between you and Moreton Regional Support Services.
    • Moreton Regional Support Services does not provide ongoing compliance verification, and compliance obligations may change over time.
    • You assume full responsibility for how you review, use, modify, or apply the templates, including any consequences arising from their use.
  5. PURCHASES & PAYMENT TERMS
    • All purchases are final. We do not offer refunds or exchanges unless required under Australian Consumer Law (ACL).
    • Prices are listed in Australian Dollars (AUD) and include GST (where applicable).
    • Payment must be made in full before access to any template or service is granted.
    • In the case of a chargeback or payment dispute initiated by the customer, we reserve the right to revoke access to all purchased templates, downloads, and associated updates until the matter is resolved. If the chargeback is deemed fraudulent, access may be permanently terminated. See Section 15 for more.
  6. CUSTOMISATION SERVICES
    • We offer customisation services for an additional fee:
    • $400.00 AUD for the NDIS Provider Pack
    • $70.00 AUD for the Independent Support Worker Pack
    • Once purchased, you will receive a secure link to a Google Form to provide your business details. This may include:
    • Business name and trading name
    • ABN and registration type
    • Team structure (if applicable)
    • Key contact names and emails
    • Policy-specific preferences
    • You will also be required to provide branding files (e.g., logo) and any other information requested by Moreton Regional Support Services in order to complete the customisation. This may include uploading logos or documents to a shared folder or email address.
    • What we customise includes:
    • Logo and branding across all documents
    • Business name, contact information, and basic structural elements
    • Terminology adjustments to suit your organisation’s language
    • Document content tailored to include applicable preferences (e.g., escalation pathways, reporting roles)
    • Important: Some documents (e.g., Employee Welcome Packs) are specific to internal business operations. While we will enter your business data, you are responsible for reviewing and updating any internal or cultural content that cannot be standardised.
    • Upon completion of your customisation, you will receive a new download link containing your tailored templates.
  7. INTELLECTUAL PROPERTY
    • All templates, website content, and branding remain the intellectual property of Moreton Regional Support Services.
    • You are granted a non-exclusive, non-transferable licence to use the purchased templates for your business only.
    • You may not resell, redistribute, modify for resale, or share our documents, in whole or part, without written permission.
  8. ACCESS, LICENSING & DOWNLOAD USE

    • Upon purchase, you are granted a non-exclusive, non-transferable licence to access and use the purchased templates for your own business operations only.

    • Access is intended for use by the purchaser and their business across reasonable personal devices and internet connections (for example, home, office, or mobile devices used by the purchaser).

    • Purchased templates, download links, and access credentials must not be shared with third parties, including other businesses, contractors, friends, or unrelated individuals.

    • Access logs and download activity are monitored to protect our digital assets and prevent unauthorised use.

    • Excessive, abnormal, or suspicious access patterns (including but not limited to repeated downloads across multiple unrelated locations, devices, or users) may be flagged for review.

    • Where access patterns indicate potential misuse, sharing, or licence breach, Moreton Regional Support Services reserves the right to:

    • Temporarily restrict or suspend access while the matter is reviewed

    • Request clarification from the purchaser

    • Permanently revoke access where misuse or redistribution is confirmed

    • Any restriction or revocation of access due to licence breach or misuse does not entitle the purchaser to a refund.

  9. LIMITATION OF LIABILITY
    • To the fullest extent permitted by law, Moreton Regional Support Services disclaims all liability for any loss, damage, claim, or legal issue arising from the use of our templates.
    • We do not guarantee the accuracy, completeness, or suitability of any template for your specific needs.
    • We are not responsible for:
    • Compliance failures due to misuse, modification, or failure to adapt documents to specific business or legislative needs.
    • Errors, omissions, or outdated information contained within the templates.
    • Changes in legislation or NDIS requirements after purchase.
    • Any indirect or consequential damages, including business losses, regulatory fines, or legal disputes.
    By purchasing and using our templates, you acknowledge that:
    • These are templates only designed to provide document structure layout and any content of all documents must be reviewed and amended to match any NDIS and legislative requirements. It is on the purchaser to seek advice to ensure legality of the documents contents.
    • You do so at your own risk and that Moreton Regional Support Services is not liable for any consequences arising from their use.
    • Our liability, where it cannot be lawfully excluded, is limited to the re-supply of the purchased document templates or a refund at our discretion, as per Australian Consumer Law (ACL).
  10. NO LEGAL OR PROFESSIONAL RELATIONSHIP
    • Purchasing or using our templates does not establish any legal, business, or advisory relationship between you and Moreton Regional Support Services.
    • We are not your consultants, lawyers, or business advisors.
  11. PRIVACY & DATA PROTECTION
    • We collect and store personal information in accordance with the Privacy Act 1988 (Cth).
    • Your data will never be sold or shared with third parties without consent, except as required by law.
    • Our website and online store operate through Shopify, which has its own privacy policy governing the collection and use of customer data. We recommend reviewing Shopify’s Privacy Policy at https://www.shopify.com/legal/privacy for more details on how your data is managed.

  12. THIRD-PARTY LINKS & RESOURCES
    • Our website may contain links to third-party websites or resources.
    • We do not endorse, control, or take responsibility for external content, services, or policies.
  13. FORCE MAJEURE
    • We are not liable for failure to fulfill obligations due to events beyond our reasonable control, including but not limited to:
    • Natural disasters
    • Government regulations or legal changes
    • Cyberattacks, system failures, or internet disruptions
  14. GOVERNING LAW & DISPUTE RESOLUTION
    • These Terms of Service are governed by the laws of Australia.
    • Any disputes must first be resolved through negotiation or mediation. If unresolved, disputes will be subject to the jurisdiction of Australian courts.

  16. FRAUDULENT ACTIVITY & CHARGEBACK• Any chargeback, payment reversal, or dispute raised with your bank or card provider may result in the immediate suspension or termination of access to your purchased templates, download links, and any associated updates or customisations.

• If a transaction is flagged as fraudulent or unauthorised, Moreton Regional Support Services reserves the right to permanently revoke access to all current and past purchases linked to the account and deny any further services.

• Any attempt to repurchase products following a chargeback, reversal, or fraudulent claim—whether under the same name, email address, billing details, or business name—will be flagged and manually reviewed.

• We reserve the right to cancel, block, or refund any future orders made under accounts that match known fraudulent activity or past chargeback history, even if a new purchase is successfully processed at checkout.

• These actions are taken to protect the integrity of our services and digital assets and to prevent abuse of the purchase and chargeback system.

• False, malicious, or repeated chargebacks may result in your information being reported to payment processors (e.g., Shopify Payments, Stripe, PayPal) and other relevant authorities in accordance with Australian Consumer Law and online fraud prevention protocols.
